Ületunnitöö tegemine nõuab pooltevahelist kokkulepet (TLS § 44 lg 1). Töötajal on õigus keelduda ületunnitöö tegemisest kui ta seda teha ei soovi või tegemine ei ole võimalik.
Tööandja võib nõuda töötaja nõusolekuta ületunnitöö tegemist ainult erandjuhtudel, kui ületunnitöö tegemine on vajalik ettenägematutel asjaoludel nt kahju tekkimise ärahoidmiseks).
Töölepingu ülesütlemine võib toimuda seaduses antud alustel, tööandjapoolse erakorralise ülesütlemise alused on sätestatud TLS §-s 88. Kui töötaja ületunnitööd teha ei soovi ja selle tegemiseks ei ole ka ettenägematuid asjaolusid, tuleb sellest tööandjale teada anda. Ületunnitööst keeldumine ei ole aluseks töölepingut üles öelda.
